Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Quiva iOS application ("App") and website at getquiva.app ("Site"), operated by COSARCA ST DANIEL MARIUS PERSOANA FIZICA AUTORIZATA ("we", "our", or "us"), a sole trader registered in Romania.

By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use Quiva. By using the App you confirm that you meet this requirement. If you are under 18, you confirm that you have your parent or guardian's permission.

2. The Service

Quiva is an AI-powered iOS app that generates text summaries and mind maps from YouTube videos. The App retrieves publicly available video transcripts and processes them using a third-party AI model to produce the summary.

3. Your Account

Quiva does not require you to create an account. The App operates on your device using local storage. You are responsible for maintaining access to your device and any data stored on it.

4. Subscriptions and Payments

Quiva offers a free tier and a Pro subscription. The following terms apply to subscriptions:

• Free tier — limited to 3 summaries per day and videos up to 30 minutes in length. Access to the last 10 history items only.
• Pro subscription — unlocks 100 hours of video per month, videos of any length, all summary styles, full history access, and priority features. Available as a monthly or annual plan.
• Free trial — annual Pro subscriptions include a 7-day free trial for new subscribers. The trial automatically converts to a paid subscription at the end of the trial period unless cancelled beforehand.
• Billing — all payments are processed by Apple via the App Store. Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date.
• Cancellation — you may cancel your subscription at any time through your Apple ID settings. Cancellation takes effect at the end of the current billing period. You will retain Pro access until that date.
• Downgrade — when your Pro subscription ends, your account reverts to the free tier. All summaries and mind maps you created remain accessible, subject to the free tier history limit of 10 items.
• Refunds — all purchases are final and non-refundable, except where required by applicable law. Refund requests must be submitted directly to Apple in accordance with their refund policy.
• Price changes — we reserve the right to change subscription prices. Any price change will apply at your next renewal date and you will be notified in advance by Apple.

5. Ownership of Your Content

You own the summaries and mind maps generated through your use of Quiva. We make no claim to any content you create using the App. You may export, share, or use your summaries for any personal or commercial purpose.

By using the App you confirm that you have the right to submit any YouTube URLs you provide, and that your use of the resulting summaries complies with YouTube's Terms of Service and applicable copyright law.

6. Acceptable Use

You agree not to use Quiva to:

• Violate any applicable law or regulation.
• Attempt to reverse engineer, decompile, or extract the source code of the App.
• Circumvent or attempt to bypass usage limits, paywalls, or security features.
• Use automated tools to submit video URLs in bulk or overload our backend infrastructure.
• Resell, sublicense, or redistribute access to the App or its output as a standalone service.

7. Intellectual Property

All intellectual property in the Quiva App — including its design, code, branding, name, and logo — is owned by COSARCA ST DANIEL MARIUS PERSOANA FIZICA AUTORIZATA. Nothing in these Terms grants you any right to use our trademarks, trade names, or branding.

8. Third-Party Services

Quiva relies on third-party services including Firebase (Google LLC), Railway, Supadata, Apple StoreKit, and YouTube. Your use of the App is also subject to the terms and policies of these providers. We are not responsible for the availability, accuracy, or conduct of any third-party service.

Quiva is not affiliated with, endorsed by, or sponsored by YouTube or Google LLC.

9. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:

• The App will be uninterrupted, error-free, or available at all times.
• Summaries will be accurate, complete, or suitable for any particular purpose.
• The App will be compatible with all devices or iOS versions.

10. Limitation of Liability

To the fullest extent permitted by Romanian and EU law, COSARCA ST DANIEL MARIUS PERSOANA FIZICA AUTORIZATA shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the App, including but not limited to loss of data, loss of profits, or reliance on AI-generated content.

Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid for the App in the 12 months preceding the claim.

11. Governing Law

These Terms are governed by the laws of Romania. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Romania, without prejudice to any mandatory consumer protection rights you may have under EU law.

If you are a consumer resident in the European Union, you may also be entitled to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date above. Continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
